'Sue Your Boss' Law Leaves California Employers Open to Meritless Lawsuits

Three California Chamber of Commerce-sponsored bills intended to modify or repeal the costly "sue your boss" law (SB 796) have failed to pass committees in the last month. SB 796 permits employees and former employees to bring private enforcement lawsuits for alleged Labor Code violations without ever informing state labor law enforcement officials or the private or public employer of the alleged violation. It leaves all types of employers vulnerable to a wide array of new civil lawsuits, and provides new incentives for unfair competition lawsuits.
